Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Trivington mobile application ("the App"), operated by Paul Montbleau ("we," "us," or "our"). By downloading, installing, or using Trivington, you agree to be bound by these Terms. If you do not agree, please do not use the App.

1. Eligibility

You must be at least 13 years of age to use Trivington. By using the App, you represent that you meet this requirement. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

2. Account Registration

To access certain features of Trivington, you must create an account. You agree to provide accurate information and to keep your login credentials secure. You are responsible for all activity that occurs under your account. If you suspect unauthorized access, please contact us immediately.

3. Acceptable Use

You agree to use Trivington in a fair and respectful manner. You may not:

• Use cheats, exploits, automation, or any unauthorized third-party tools to gain an unfair advantage
• Harass, abuse, or threaten other players
• Impersonate another person or misrepresent your identity
• Attempt to interfere with, disrupt, or compromise the App's infrastructure or security
• Use the App for any illegal or unauthorized purpose
• Create multiple accounts to manipulate leaderboards or matchmaking

We reserve the right to suspend or terminate accounts that violate these rules, at our sole discretion and without prior notice.

4. In-App Purchases

Trivington may offer optional in-app purchases in the future. All purchases are processed through Apple's App Store and are subject to Apple's terms and conditions. All sales are final unless otherwise required by applicable law. We do not collect or store your payment information — all transactions are handled by Apple.

5. Intellectual Property

All content in Trivington — including but not limited to questions, graphics, design, code, logos, and branding — is owned by us or our licensors and is protected by applicable intellectual property laws. You may not copy, modify, distribute, sell, or create derivative works based on any part of the App without our prior written permission.

6. User Content

If you submit any content through the App (such as a username or profile information), you grant us a non-exclusive, royalty-free, worldwide license to use, display, and distribute that content within the App for the purpose of operating Trivington. You are solely responsible for the content you provide and represent that it does not violate any third-party rights.

7. Availability & Updates

We strive to keep Trivington available and up-to-date, but we do not guarantee uninterrupted access. The App may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We reserve the right to modify, update, or discontinue any features or the App itself at any time without prior notice.

8. Disclaimer of Warranties

Trivington is provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the App's reliability, accuracy, fitness for a particular purpose, or non-infringement. Your use of the App is at your own risk.

9. Limitation of Liability

To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the App. Our total liability for any claim arising from these Terms or your use of Trivington shall not exceed the amount you paid to us (if any) in the twelve months preceding the claim.

10. Termination

You may stop using Trivington at any time by deleting your account and uninstalling the App. We may suspend or terminate your access at any time, with or without cause, including for violation of these Terms. Upon termination, your right to use the App ceases immediately.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts located in San Diego County, California.

12. Changes to These Terms

We may revise these Terms from time to time. If we make material changes, we will notify you through the App or by other reasonable means. Your continued use of Trivington after the revised Terms become effective constitutes your acceptance of the changes.
